Security camera footage partially showing a failed robbery of a drug dealer, which resulted in the death of Jermaine Lacey.


The plan seemed simple. Zachary Kirton would meet up with "Cookie" under the guise of buying marijuana. While the 18-year-old distracted the dealer, Jermaine Lacey would rob him. They’d make off with whatever they could, according to Palm Beach County Sheriff’s Office records.

But gunfire erupted after 22-year-old Lacey opened the driver’s side door of Cookie’s white Chevrolet Camaro the evening of Nov. 10 in the Lake Worth Village Mobile Home Park off Lake Worth Road west of Military Trail. Lacey was killed — multiple gunshot wounds, authorities said — and Kirton ran. He was too afraid to grab the marijuana, he told authorities during an interview last week.

Kirton was arrested on second-degree felony murder and attempted armed-robbery charges. Judge Dina Keever-Agrama ordered that he be held on without the possibility of posting bail, despite his attorney Richard Lubin’s request for the teen to be on in-house arrest.

Kirton is training to be a firefighter, Lubin told the court, and doesn’t have a criminal history. He lives with his parents in suburban West Palm Beach.

"There’s no suggestion that Mr. Kirton had a firearm, used a firearm, touched a firearm or anything in that regard," Lubin said. "It’s not as if he’s a shooter or came to shoot anyone."

According to Kirton, he and Lacey, a Boynton Beach resident, just wanted to rob the dealer, who Kirton knew as Cookie.

Surveillance-camera footage from the mobile-home park shows the two walking toward the parking lot together that evening. Lacey eventually walked away, according to sheriff’s office records, and Kirton stayed behind. He reportedly paced the parking lot, repeatedly stopping to tie his shoes. Video then shows him on the phone, and minutes later a white Chevrolet Camaro with dark tint and custom rims picks him up and they drive off.

The car returns and stops in a parking space. Video reportedly shows Lacey running toward the car — Kirton is in the passenger seat next to "Cookie" — reaching toward his waistband. Kirton told authorities he knew Lacey had a gun on him that night.

Lacey opened the driver’s-side door, then dove away from the car. Kirton got out and ran. He said he heard multiple gunshots. Video shows the Camaro speed away.

By the time deputies arrived, Lacey was dead. They found his body at the scene laying near a .38-caliber handgun and two .40-caliber shell casings.

Kirton’s family declined to speak to the media after the teen’s first appearance. About 20 people showed up for his brief court hearing at the jail.

"This isn’t a situation where you have someone with a record or a violent guy who’s ever hurt anyone in his life, or anything like that," Lubin said after the hearing. "We will be asking for and making a presentation for bond to be set."
